How to get Big Tech to play fair: Rights and remedies for public service media in EU law 

Big Tech impacts public service media’s ability to fulfil their remit of delivering trustworthy, independent information and diverse content. The EBU published a new guide breaking down current challenges posed by Big Tech to public service media and outlines the legal tools available to address them.

On 24 June, the EBU published a new guide 'Big Tech, fair play: PSM rights and remedies under the EU digital legal framework'. This publication breaks down the current challenges posed by Big Tech to public service media and outlines the legal tools available to address them.

"Big Tech shapes what audiences see and their motivations are about profit, not the public good. This has instigated and enflamed debates in many countries. European media often bears the brunt. But there is hope. Proper enforcement of regulations and effective regulatory oversight can help balance the scales.” said Richard Burnley, EBU’s Director of Legal & Policy. He continued “Today, we release our guide for public service media to understand their rights and help consider appropriate legal remedies vis-à-vis these global platforms in the EU’s digital rulebook. It gives them the legal clarity and tools they need to defend their visibility, independence, and vital role in our democracies.”

From creating obstacles in content distribution and discoverability to concerns over data exploitation, Big Tech continues to impact public service media’s ability to fulfil their remit of delivering trustworthy, independent information and diverse content to audiences. Our new guide is intended to help public service media understand their legal rights and remedies to Big Tech infringements of the EU digital legal framework.
